Terms and Conditions

These website terms and conditions govern your use of this website, Sarah Hawley – Online Coach and Personal Trainer, and your relationship with Sarah Hawley – Online Coach and Personal Trainer. Please read these terms carefully as they affect your rights and liabilities under the law.

If you do not agree to these terms, please do not use the website, or purchase any of my services. By purchasing any of my services, you acknowledge that you have read, understood, and agree to these terms.

DESCRIPTION OF SERVICES

Premium Online Coaching includes:

A fully tailored program designed to suit your specific goals, fitness level and experience, training preferences, injury history, and lifestyle.

Specialised workouts that are customised to your training environment, whether in a gym or at home.

Nutritional guidance to help you fuel your body and reach your goals (guide only, please consult a dietician for specific requirements).

Initial consultation via call, ongoing support including weekly check in online and fortnightly calls, all sessions monitored and adjusted as required, updated programs designed for progression.

12 week initial program (starts when program has been provided to you), then option to continue on a four weekly basis.

Cost of initial 12 week program is $600 total – Paid upfront, or 3 x $200 installments every four weeks, in advance. Option to continue training on a four weekly basis after initial 12 weeks, with ongoing payments made in advance.

Online Coaching includes:

A tailored program designed to suit your specific goals, fitness level and experience, training preferences, injury history, and lifestyle.

Workouts that are customised to your training environment, whether in a gym or at home.

Nutritional guidance to help you fuel your body and reach your goals (guide only, please consult a dietician for specific requirements).

Initial consultation via call, fortnightly check in online, updated programs designed for progression.

12 week initial program (starts when program has been provided to you), then option to continue on a four weekly basis.

Cost of initial 12 week program is $360 total – Paid upfront, or 3 x $120 installments every four weeks, in advance. Option to continue training on a four weekly basis after initial 12 weeks, with ongoing payments made in advance.

Program Only includes:

Program only – designed to suit your overall goal, fitness level and experience, training preferences, injury history, and lifestyle.

Workouts are customised to your training environment, whether in a gym or at home.

Nutritional guidance to help you fuel your body and reach your goals (guide only, please consult a dietician for specific requirements).

Initial consultation. Subsequent consultations for each new 4 week program purchased.

Training programs will be delivered via the ABC Trainerize app.

Cost of program only is $60 paid upfront.

Face to Face Personal Training includes:

Free initial consultation and 30 minute mini training session.

Personalised instruction.

An online program designed to suit your overall goal, delivered via the ABC Trainerize app.

1 on 1 sessions, 30 minutes $60.

1 on 1 sessions, 45 minutes $75.

2 on 1 sessions, 45 minutes $55 per person. Both clients must be up to date with payments.

CLIENT OBLIGATIONS

You must ensure that all information provided by you is accurate and current.

You must disclose any medication you take, any previous or current injuries, and complete the medical questionnaire before commencement of training. You must notify me of any changes, as and when they occur.

While I believe that for most people, following my programmes will lead to desired results, all exercise programmes depend on the individual. Results may vary depending on factors such as effort, response of the body and mind, medical conditions, and adherence to the guidelines, however in some circumstances even where an individual has followed their programme, they may not achieve the desired results. I therefore provide no warranties of any kind.

PAYMENT TERMS

For Premium Online Coaching and Online Coaching programs, payments are to be made upfront or every four weeks, in advance. Option to continue training on a four weekly basis after initial 12 weeks, with ongoing payments made in advance.

If first payment has already been made, the initial start date for Premium Online Coaching and Online Coaching may be deferred for up to one month. Payments must be made before you will be provided with programs and services. If payments are not up to date, your contract will be cancelled, no refunds will be issued, and you will not be entitled to any future contracts.

If you choose to continue with Premium Online Coaching or Online Coaching after your initial 12 week program, you are required to pay in advance every four weeks. You may cancel this any time. There is no cancellation fee, however no refunds will be issued.

Program Only package requires full payment at the time of booking – non-refundable.

For face to face personal training, payments are to be made at least one week prior to training sessions. If training with a friend, both clients must be up to date with payments before training sessions, otherwise clients will be liable for a full price individual session. Payments must be made before a training session is provided. If payment is not made, your session will be cancelled and you will be notified. A minimum of 24 hours notice is required for all cancellations, otherwise you forfeit your session. Cancelled sessions will be rescheduled if more than 24 hours notice is provided, however no refunds will be issued.

I reserve the right to terminate any services, if payments are not up to date.

REFUND POLICY

Sarah Hawley – Online Coach and Personal Trainer does not offer any refunds.

LIMITING LIABILITY

Nothing in these terms and conditions will:

Limit or exclude liability for death or personal injury resulting from negligence;

Limit or exclude liability for fraud or fraudulent misrepresentation;

Limit or exclude any liabilities in any way that is not permitted under applicable law.

I will not be liable to you in respect of any losses arising out of events beyond my reasonable control.

To the maximum extent permitted by law, I accept no liability for any of the following: 

Any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

Loss or corruption of any data, database or software;

Any special, indirect or consequential loss or damage.

The limitations of liability within the Terms do not exclude rights that may not be excluded by law, including but not limited to, those rights under the Australian Consumer Law.

USE OF IMAGES AND TESTIMONIALS

By providing any content for distribution by myself (such as before and after photographs, and testimonials) you expressly grant me a worldwide, royalty-free, perpetual, irrevocable licence to use, copy, store, perform, display and distribute such content.

MEDICAL HISTORY QUESTIONNAIRE

The medical history questionnaire is compulsory. It ensures that I am made aware of any medical conditions or injuries, and I can assess whether it is appropriate for you to begin training, or if I need to request you be cleared by a medical professional before you start training.

DISCLAIMERS AND WAIVER

You, the client, understand that any physical activity carries with it an inherent risk of injury. Strength training can involve strenuous exertions of various muscles placing stress on the muscles, bones, and joints. Cardiovascular training can involve sustained physical activity placing stress on the heart, arteries, and blood pressure. Risk of injury may be minor such as soreness, sprains, strains, and bruises, or serious such as heart attack, stroke, paralysis, and death. You understand these risks and agree to assume all risk of injury or illness associated with exercise whatever the cause, and voluntarily and knowingly agree to waive any existing right to take legal action against my business.

I am not a medical practitioner or registered dietician. I strongly recommend that prior to commencing any diet or exercise regime that you consult a medical practitioner and/or registered dietitian first.

I have no expertise in diagnosing, examining, or treating medical conditions of any kind, or in determining the effect of any specific exercise or diet on a medical condition. I will only use my services to propose possibilities for improving your health.
